The State and the Government system
There are three principles set by the constitution for the government system in the State of Kuwait. They are:
Kuwait is an Arab State, independent and fully sovereign; the government system is democratic, and sovereignty is, for the nation, the source of all authority.
The system of government is based on the principle separating the powers, functioning in cooperation with each other.
The legislative authority is taken by the Amir and the National Assembly, while the executive authority is taken by the Amir Council of Ministers and Ministers.
The Constitution
Kuwait's Constitution is based on democratic principles, as it combines the positive aspects of the presidential system and the popularity of the Parliamentary system prevalent in advanced democratic countries.
Some of the most important characteristics of these principals are. the nation's sovereignty, citizens freedom, and quality by law.
Kuwait's Constitution has 183 articles under five parts. They are:
Kuwait’s Constitution was written and prepared by an elected 20-member constituent Assembly, and 11 ministers. The, ministers refrained from voting on the approval out of their wish to leave that for the elected members alone.
Preparation and discussion of the Constitutions articles lasted six months. On Nov. 11, 1962, the late Sheikh Abdullah Al -Salem Al - Sabah approved the constitution draft as they prepared it without any changes.
The constitution did not come into effect until Jan. 29,1963 when the first National Assembly convened.
The Amir of the country
The head of state is the Amir, and his official title is “His Highness the Amir of the State of Kuwait”.
The Constitutions’ articles say that the Amir will assume his authorities through his ministers, and that his person shall be immune and inviolable; article 58 of the constitution says: The prime minister and the ministers shall be collectively responsible to the Amir for the general policy of the state.
